Family & Medical Leave General Information
The FMLA stipulates that employees are eligible for family medical leave for matters that include:
- Birth and care of a child
- Acceptance of an adopted child or foster child into the family
- Care for a spouse, child, or parent with a serious medical condition
- The employee's own serious health condition
Under provisions of the act, the employee's job cannot be eliminated unless the employer provides a position of equal or greater compensation and responsibility upon return from medical leave. In addition, the employee can suffer no employer retaliation, harassment, or discrimination as a result of taking family medical leave.
